solution was changing the apache directive to the following

MaxRequestsPerProcess 1000
DefaultMaxClassProcessCount 120
IdleTimeout 60
MaxProcessCount 2000
IPCCommTimeout 40
IPCConnectTimeout 10
MaxRequestLen 10240000
